Aims

To develop and enhance upon a student’s existing knowledge of procedure and practice obtained during the Criminal Litigation course completed in Stage 1. Students will gain relevant knowledge and skills to deal with complex matters at the police station, dealing with youth offenders and to understand and argue factors for and against bail and to prepare for trial, sentence and appeal. The elective also considers other areas common to practice including immigration and sentencing in relation to motoring offences. The elective also focuses on more complex advocacy within the youth and Magistrates Court.

Learning Outcomes

1.
Demonstrate an understanding of the relevant law and practice relating to the effective provision of legal advice to youths and adult suspects whilst under arrest and/or interview with the police.
2.
Demonstrate an understanding of the Youth Court in relation to procedure, bail, jurisdiction, sentencing powers and rights of appeal regarding criminal matters from a defence and prosecution perspective.
3.
Demonstrate an understanding of immigration related criminal offences, penalties and courts powers and an awareness of the practical issues faced by practitioners whilst advising persons under arrest and subsequently charged with immigration offences.
4.
Demonstrate an understanding with respect to the prosecution and sentencing with respect to road traffic offences.

Module Overview:
This module aims to advance students' knowledge of legal procedure and practice, focusing on complex matters at the police station, youth offender representation, bail arguments, trial preparation, sentencing, and appeals. It also covers additional areas like immigration and motoring offenses, with an emphasis on advanced advocacy in the youth and Magistrates Court.

This is an elective on the LPC as dictated by the relevant professional bodies.
