Aims
To develop an understanding of the law and practice in relation to export sales and the movement of goods with particular reference to the carriage of goods by sea, and current practice in the fields of shipbroking and vessel chartering.
Learning Outcomes
1.
Review chartering practice from an economic-administrative point of view.
2.
Relate vessel chartering practice to port and vessel costs.
3.
Demonstrate a critical understanding of the law relating to international sales and the carriage of cargo.
4.
Appraise the International Conventions that govern the Carriage of Goods.
5.
Critically evaluate how the Doctrine of Privity affects third party rights and duties.
6.
Analyse Cargo Claims and legal issues involving carriers and charterers.

Outline Syllabus:
Chartering: Overview of ship chartering market. Participants in the freight market and their interests and concerns. Basic concepts of ship chartering and charterers. Owning v chartering and appraisal of risks. Role and liability of shipbrokers. Voyage and time chartering practice; Voyage, time, bareboat or demise charter Main charter terms and practical considerations in drafting charterparties. Carriage of Goods Law: Export Trade Contracts: Sale of Goods Act 1979 Consumer Rights Act 2015 "Himalya Clauses" and 3rd party protection Express and implied terms in contracts of affreightment Contracts under the common Law and the Carriage of Goods by Sea Act 1971 Hague-Visby Rules, Hamburg Rules, Rotterdam Rules Cargo claims & ADR (Alternative Dispute resolution) INCOTERMS; CIF & FOB contracts, multimodal contracts of carriage Limitation of Liability, and the application of limitation clauses upon third parties Charterparties; time, voyage, demise Laytime and Demurrage Insurance Claims; P&I Clubs and Commercial underwriters Particular issues within road and air transport
