Aims

To provide knowledge, understanding and application of the UK legal system and the principles of contract law with particular reference to the construction industry.

Learning Outcomes

1.
Evaluate the legal systems within the UK in relation to the Built Environment.
2.
Evaluate the impact of Tort law within the construction industry.
3.
Critically evaluate the structure and content of the various forms of contracts used within the built environment.
4.
Be able to apply legal knowledge to situations commonly occurring during the construction process, specifically around litigation, identifying the structure for mediation and arbitration.

Module Content

Outline Syllabus:-Sources of law, public and private law, the court system and procedures -The importance of contract and tort within the construction industry and the effect of new legislation on common law. -Tort within the construction industry, occupier’s liability, employer’s liability, -Standard forms of contract used in the industry, appropriate applications, minor to major contract types and relevant Supporting documentation. Codes of Practice and Professional Guidelines. -Contractor's obligations; time, variation, certification and payment provisions and ending a construction contract (including delay, expense, damages and practical completion). -Elements of a contract, parties, responsibility and liability, capacity, offer, acceptance, consideration, defects in contracts, breaches and remedies. Duty of agents. Dispute resolution, ADR and provision for arbitration. -The legal status of the firm, corporations and requirements for formation and closure. Other forms and purposes of contracts-employment, services, goods, use of land, purchase of land. -Property law.
Additional Information:This module develops an understanding of contract law with reference to the construction industry, including the role, obligations and responsibilities of the employer and the contractor under construction contracts, and key matters arising during the course of a construction contract.
