Aims

To provide students with a critical understanding of the legal responses to the formation, dissolution and regulation of domestic partnerships. To critically evaluate the law in relation to the parent/child relationship, domestic violence, children’s rights, welfare support, parental separation, divorce and financial provision upon dissolution of marital relationships.

Learning Outcomes

Demonstrate a critical understanding of the legal context and regulation and dissolution of various familial relationships.

Demonstrate a critical understanding of the law and policy issues relating to familial violence.

Demonstrate a critical understanding of the impact of human rights law on family law

Demonstrate a critical understanding of the law relating to children and welfare support.

Demonstrate a well-developed ability to use a wide variety of standard and legal and other electronic sources of information.

Module Content

Outline Syllabus:• Domestic Relationships: Family, Marriage and Civil Partnerships, Marriage (Same Sex Couples) Act 2013 • Parenthood and Parental Responsibility –The Children Act 1989 • Domestic Violence –law, social policy, government initiatives, police response, Reports –The Family Law Act 1996, Protection from Harassment Act 1997 • Children’s Rights, Gillick competence, the Children Act 1989 and the medical treatment of children, UN Convention on the Rights of the Child 1989 • Child Welfare and Support-the Child Support Act 1991, Child Maintenance and Other Payments Act 2008 • Parental Separation-Children Act 1989, Children and Families Act 2014 • Divorce-the law, social policy, post-divorce arrangements, financial awards post-divorce, the Matrimonial Causes Act 1973
Module Overview:
To provide students with a critical understanding of the legal responses to the formation, dissolution and regulation of domestic partnerships. To critically evaluate the law in relation to the parent/child relationship, domestic violence, childrens rights, welfare support, parental separation, divorce and financial provision upon dissolution of marital relationships. The workshops in this Module will not follow the structure of the usual Law tutorials/seminars where students are required to answer a number of questions on a certain topic. Students sign up and attend the particular workshops which will discuss the particular topic which they wish to write an essay on.
