Aims
Topic 1 Introduction to Planning Law
This will introduce the topic of planning law in England and will set out relevant primary and secondary legislation. It will also deal with the various bodies involved in the planning process and will briefly allude to the variations to planning systems in Scotland, Wales and Northern Ireland.
Topic 2 Development Plans
This topic will explore the role of planning policy in the planning system and the primacy of the development plan. It will also look at the newer system of neighbourhood planning which was introduced by the Localism Act 2011.
Topic 3 Development Management
This a large topic that looks at the principles of development, what does or doesn’t need planning permission, and how local planning authorities make decisions on planning applications. It will also look at issues including the use of planning conditions and planning gain, including the Community Infrastructure Levy. Brief reference to Environmental Impact Assessment will be made.
Topic 4 Enforcement
This is the most confrontational and legalistic element of planning control. This topic will look at the law underpinning the principles of enforcement and the options available to local authorities to take enforcement action against unauthorised development.
Topic 5 Appeals and Judicial Review
This will give an overview of the appeal process to the Planning Inspectorate. It will also examine the range of options for judicial review and the role of the courts, including that of the Planning Court.
Topic 6 Other Special Planning Controls
This will give a brief overview of heritage planning, minerals and waste, and compulsory purchase.
Learning Outcomes

Effectively analyse and critically evaluate practices within the planning law field

Exhibit a wide awareness of planning law, and the ability to apply it critically in a variety of contexts
