Aims

This module provides students with a grounding in the background law needed to fully understand the legal landscape in which alternative dispute resolution operates. This module has been designed to support both those with, and those without, a legal background. The assessments have been designed specifically to enable non-lawyer/legal background students to gain a firm grasp of legal writing, including syllogistic reasoning. Furthermore, this will ensure that lawyers/legal background students entering the course are refreshed in academic rigour, and stretched/challenged, in preparation to work as masters (FHEQ 7) level.

Examine, in detail, the English legal system

Critically appraise the need for alternative methods to court action
3.
Critically assess the legal processes of litigation in comparison to alternative dispute resolution
4.
Analyse and provide solutions to common problems arising in alternative dispute resolution

Outline Syllabus:By completing this module, students are expected to cover the indicative content as follows: a. A grounding in the law applicable to ADR, including: b. English Legal Systems c. Tort d. English legal system e. Law of Contract f. Law of Tort g. Causation and Remoteness of Damage h. Law of property i. Expert Evidence j. Burden and Standard of Proof in Civil Cases k. Evidential Rules around Testimony l. Law relating to ADR m. ADR Framework/methods
