Aims

The module will provide students with an understanding of: the scientific, policy and legal basis for environmental permitting systems and related practices and procedures; and complementary climate change and energy management regulations, trading systems and corporate reporting requirements.

Learning Outcomes

An understanding of current EU and national policies, laws, practices and procedures regulating the environmental aspects of industrial operations and commercial activities through a permit-based system
2.
An appreciation of the interfaces between environmental permitting and climate change and other key areas of regulation
3.
An overview of the current climate change/ energy management regulatory framework, its scope, application and key practical implications
4.
An appreciation of key operational compliance requirements arising from environmental permitting regulations and of regulatory powers and interventions
5.
An understanding of the practical considerations arising in a transactional context; and
6.
A critical perspective on current environmental permitting and climate change regulatory systems.

Module Content

Outline Syllabus:Environmental Permitting: • The evolution of integrated environmental permitting systems • Policy basis - international, EU and national dimensions • EU Directives, national transposing legislation and technical guidance • Scope and interfaces with other key areas of EU and national regulation • Requirement for a permit and key concepts • Categories of permits, exemptions and exclusions • Procedural aspects, including applications, variations, surrender etc. • Operational compliance and associated risks and liabilities • Regulator interventions, practices, enforcement powers and sanctions • Impacts on real estate and corporate transactions and development control • Case law and current and emerging issues • Critical appraisal of the current regulatory approach towards permitting in relation to achieving legal objectives and environmental sustainability Climate Change Regulation: • Climate change and energy management: the evolving regulatory system and its interface with environmental permitting • Key EU and national climate change regulatory controls, links with international mechanisms • Climate change agreements – legal basis, types, scope, qualification, compliance aspects • Cap and trade systems – principles, EU and UK schemes, scope, qualification, permitting and registration requirements, practice and procedures • Issues arising in a transactional context • Corporate reporting
