Aims

This module aims to provide students with an appreciation of the historical background to construction contract law, as well as an understanding of contemporary international contexts. The module will focus on recent developments including design responsibility, risk allocation and management, partnering-type initiatives and global patterns of contract use.

Compare and contrast standard forms of contract common to the international construction industry, with particular reference to recent developments

Scrutinise risk allocation and legal risk management

Critically evaluate design responsibility and obligations under tort

Critically survey global patterns of contract use in the international construction sector

Module Content

Outline Syllabus:By completing this module, students are expected to cover the indicative content as follows: a. Historical background: a. Roles and responsibilities of parties b. Procurement and contract choice – what does the client want? b. Contracts risk: a. Standard forms of contracts compared and contrasted – JCT, NEC, FIDIC; b. Risk allocation and legal risk management c. The case for amendments c. Construction contracts: a. Design responsibility b. Collateral warranties and novation of professionals c. Obligations under tort d. Periods of limitation e. Recent developments in standard form contracting f. Partnering-type initiatives g. Global patterns of contract use
