Aims

The module introduces students to the fundamental legal principles governing International and English shipping Law placing highly specialised rules into a commercial marine and offshore context. Students will develop a working understanding of the law, principles and practice and the operational effects on the maritime industry.

Learning Outcomes

Demonstrate a critical understanding of the common law principles governing commercial obligation and dispute resolution

Appraise pertinent contemporary issues within salvage, collision, ship arrest and maritime liens.

Module Content

Outline Syllabus:
The legal implementation of International Conventions (UNCLOS,MARPOL,SOLAS, International Salvage Convention 1989, International Convention on the International Regulations for preventing Collisions at Sea, 1972).
EU and UK legislative instruments (Regulations, Directives, UK Acts and SI’s, Merchant Shipping Act 1995, Senior Courts Act 1981). Jurisdiction, Role of IMO,MCA, MAIB, SOSREP, EMSA.
The maritime claim, Liens (Maritime, Statutory, Possessory) . Bringing a case with review of; the Senior Courts Act 1981 and Maritime Conventions: The Admiralty Court, and the Admiralty Marshal; Arrest: Conventions 1952 and 1999. Principles of salvage and liabilities arising. Contractual provisions and Standard Forms. Towage and Wreck. Civil & Criminal Liability, Civil Remedies using Collision as an example Liability - Vicarious and Limitations of (outline)
Module Overview:
This module introduces students to contemporary issues of admiralty law that serve to demonstrate how civil and criminal liabilities can arise from the shipping and offshore business and the respective available remedies. The module focuses on the practical application of English law, covering the areas of Collision, Salvage, Towage and Wreck. Current industry commentary and cases provide exploration of the workings of the Admiralty Court and UK Supreme Court.

The module will benefit students entering into a wide range of industry related career options such as Classification Societies and Regulators, Technical, Marine and Offshore Engineering Managers, Ship Management, Salvage contractors, P&I clubs, insurance claims adjusters.
