Aims
The main aim of the Personal Injury elective is to build upon students’ existing knowledge of procedure and practice gained during the Civil Litigation course. In particular, the elective will provide students with the relevant knowledge, skills and procedure to deal with the main areas of personal injury practice including clinical negligence, disease, and fatal accident. The course will enable students to further develop skills in analysis of facts and evidence, including expert medical evidence, and assessment of quantum. Students will build on and develop knowledge of case management, negotiation and civil Litigation procedures with particular reference to multi-track litigation. The elective will focus on the multi-track as well as on the discrete areas of clinical negligence, disease and fatal accident. The elective also affords further opportunities to develop the key skills of negotiation, practical legal research, and advocacy.

• Law relating to liability in personal injury actions - Legal basis, duty of care in various actions including clinical negligence, employer’s liability, occupier’s liability and Road Traffic Accidents, Causation, Fatal Accident Claims and Initial consideration of limitation periods and quantum. • Identification of potential cause of action and risk assessment. • Detailed analysis and risk assessment • Fact and Information Gathering • Evaluating quantum • Expert Evidence • Drafting allocation claim and directions • Preparation for mediation and role play mediation • Preparation for trial and role play cross examination of expert witnesses
This Personal Injury elective expands upon students' prior understanding of civil litigation. It equips them with the knowledge and skills needed for personal injury practice, covering clinical negligence, disease, and fatal accident cases. The module enhances their abilities in fact and evidence analysis, including expert medical evidence, as well as quantum assessment. Students further develop their knowledge of case management, negotiation, and civil litigation procedures, especially in multi-track litigation. The elective focuses on multi-track litigation, clinical negligence, disease, and fatal accident cases, while providing opportunities to hone negotiation, legal research, and advocacy skills.
