Aims

To introduce the student to the underlining principles of criminal liability and any recognisable defences. To introduce the student to a range of substantive offences including Homicide, Non-Fatal assault offences, Sex offences and Property offences. To develop and harness the knowledge of the student so that they are able to demonstrate which offence(s) is/are applicable by recognising the relevant statutory and common law principles that must be established to prove that offence. To encourage the student to demonstrate an ability to use relevant legal material and present an argument which is both coherent and comprehensible.

Learning Outcomes

Demonstrate critical understanding in order to identify and evaluate the basic concepts, values, principles and rules by which liability for criminal behaviour is imposed.
2.
Demonstrate critical understanding in order to apply gained legal knowledge to complex problems, to evaluate this application and draw logical conclusions supported by legal argument and authority.
3.
Demonstrate critical understanding in order to explain and assess the legal content and social, political and ethical context of criminal law, including proposals for reform.
4.
Demonstrate critical understanding in order to undertake legal research and use appropriate legal terminology, structure and language in writing.

Outline Syllabus:General principles – Actus reus General principles – Mens Rea Strict Liability General defences: Infancy, Automatism, Voluntary and Involuntary Intoxication, Self-defence, Duress (of circumstances and of necessity) Inchoate liability Participatory liability Fatal and Non-Fatal Offences Against the Person and Harassment Property Offences: Theft, Robbery, Burglary, Blackmail, Criminal Damage
Module Overview:
This module introduces you to the essential principles of substantive offences and applicable defences. It aims to:
  • introduce the underlining principles of criminal liability and any recognisable defences
  • introduce a range of substantive offences including Homicide, Non-Fatal assault offences, Sex offences and Property offences
  • develop and harness your knowledge so that you are able to demonstrate which offence(s) is/are applicable by recognising the relevant statutory and common law principles that must be established to prove that offence
  • encourage you to demonstrate an ability to use relevant legal material and present an argument which is both coherent and comprehensible
