Aims

1.To introduce students to the core substantive, institutional and conceptual foundations of Foreign Investment Law. 2.To introduce students to the broader economic, political and social implications of international investment Law. 3.To provide students with a critical appreciation of the competing interests within the sphere of Investment Law. 4.To introduce students to the contemporary issues and debates within Investment Law.

Learning Outcomes

Critically analyse the core issues of Foreign Direct Investments and the law underpinning these transactions
2.
Evaluate the evolution of foreign investment law.
3.
Draw from a body of detailed, substantive knowledge gained through course readings, class participation and self-study and apply this to the legal and policy issues relevant to Foreign Direct Investments.
4.
Critically analyse contemporary debates relating to the protection of foreign investments and the interface between this objective and the policy imperatives of host states.

Module Content

Outline Syllabus:1.Introduction to Foreign Direct Investment: History, Trends and Rationales. 2.International Investment treaties and Investment Contracts. 3.Standards of Protection for Investors – Most-Favoured Nation and National Treatment. 4.Standards of Protection for Foreign Investors – Fair & Equitable Treatment (FET) and the rules against Expropriation of Property. 5.Conflicts between Investment Protection, Public policy considerations and the Host State’s Right to Regulate. 6.Dispute Settlement before Specialised Arbitral Tribunals – ICSID and UNCITRAL. 7.The Reform of Investment Law and Recent debates on the creation of a Multilateral Investment Court.
Module Overview:
This module aims to introduce students to the core substantive, institutional and conceptual foundations of Foreign Investment Law, as well as the broader economic, political and social implications of international investment Law. It also aims to provide a critical appreciation of the competing interests within the sphere of Investment Law and an introduction to the contemporary issues and debates within Investment Law.
