Aims

To provide an opportunity for students to acquire knowledge and skills relevant to advising clients being detained at a police station, and to prepare for trial, and sentence and to advocate on behalf of persons at stages in the criminal justices process.

Learning Outcomes

Demonstrate an understanding of the rights of suspects being detained by the police and police powers in respect of evidence gathering.

Demonstrate an understanding of the Criminal Procedure Rules, the role of the court in the litigation process from first appearance to sentencing.
3.
Demonstrate an understanding of the rules of criminal evidence.
4.
Identify and apply relevant core legal principles and rules to realistic client-based and ethical problems.
5.
Formulate and present a coherent submission based upon facts, general principles and appropriate legal authority in a structured, concise and persuasive manner.

Module Content

Outline Syllabus:The procedure and processes involved in advising clients, including vulnerable clients, at the police station. Rights of a suspect being detained by the police for questioning under PACE 1984, the Codes of Practice and the HRA 1998, including advice before interview, identification procedures, charging and bail. The procedures and processes involved in criminal litigation including bail, first and interim hearing, plea before venue and allocation, case management powers of the court and the admission or exclusion of evidence. Trial procedure, sentencing and appeal. Rules relating to the use of criminal evidence including bad character, hearsay, and confession evidence, and the admission or exclusion of evidence. Youth court procedure, jurisdiction, allocation and sentencing. The creation of a persuasive and coherent submission to the court, including modes of address and courtroom etiquette.
