Aims

The module aims to provide students with knowledge and understanding of the key aspects of the common law and statutory rules governing the relationship of landlord and tenant.

Learning Outcomes

1.
Explain and evaluate the nature and content of leases.
2.
Analyse relevant legal material and draw logical conclusions related to landlord and tenant matters.
3.
Recognise how leases can be terminated and critically explain the way in which statute law protects the rights of tenants of residential and business premises.
4.
Critically identify legal issues and the rights and obligations of landlords and tenants arising out of hypothetical scenario problems.

Module Content

Outline Syllabus:
Creation of a lease
Distinction of a legal lease from other occupancy arrangements (licence, tenancy at will)
The structure of leases and principal covenants in leases (such as rent and rent review, repair, alterations, alienation)
Difference between express and implied lease obligations
Termination of leases and remedies for breach of lease covenants
Residential tenancy law and statutory protection of residential tenancies 
Statutory protection of business tenancies
Additional Information:
Provides students with knowledge and understanding of the fundamental legal principles and statutory rules relating to Landlord and Tenant law.
