Aims

The course looks at the Sports Participant and The Courts

Learning Outcomes

Identify and prioritise source materials needed for a clear and proper understanding of the subject
2.
Demonstrate a critical awareness of the factors which currently shape the law relating to sports participants and the courts
3.
Analyse and critically appreciate the practices of the law relating to sports participants and the courts
4.
Develop critical responses to the issues at the forefront of the law relating to the sports participants and the courts, and the ability to apply it critically in a variety of contexts

Module Content

Outline Syllabus:1. Criminal and Civil Liability of Sports Participants for On-Field actions 2. Criminal Liability • Public order and violence offences • Topical issues including criminalisation of doping and match fixing • Relevant defences, in particular consent • Relationship between criminal proceedings and disciplinary proceedings • The criminal prosecution process 3. Civil Liability • Roles and purpose of tort in civil litigation • Torts of negligence and trespass to the person, including their relevant defences • Liability to other participants and to spectators • Remedies, including the role of insurance; and • Vicarious liability of governing bodies.
