Aims

The course examines the ECHR

Learning Outcomes

1.
Identify and prioritise source materials needed for a clear and proper understanding of the subject
2.
Demonstrate a critical awareness of the factors which have shaped the ECHR and the convention institutions
3.
Flexibly and creatively apply knowledge of the role performed by the European Court of Human Rights and its contribution to the interpretation and evolution of convention rights
4.
Demonstrate a deep and systematic understanding of the issues relating to the ECHR and the ability to apply them in the appropriate context

Outline Syllabus:The background to the European Convention on Human Rights The institutional framework The nature of the substantive rights How the European Convention on Human Rights can be updated The application process and the admissibility criteria The margin of appreciation and proportionality Derogation The European Union and the European Convention on Human Rights
