Aims
Building on the Medical Negligence module which concentrated on substantive legal issues, this module attempts to place the fault based system for compensating victims of medical accidents in the broader context of disciplinary processes, complaints systems and other quality assurance processes more generally and the regulation of medical practice as a whole. It will also compare and contrast alternative dispute resolution mechanisms and no fault compensation systems. Comparative dimensions will be infused throughout.

Module Content
Outline Syllabus:1. Comparative malpractice systems
2. Complaints mechanisms and their relationship with the tort system
3. Disciplinary processes (employer and regulatory) and their relationship to the tort system
4. Protection of the public and the integration of the various mechanisms, including the roles of CQC, NICE, NCAS and NPSA
5. Alternative dispute resolution procedures
6. Procedural matters including the role of experts and litigation ‘tracks’
7. Proposed reforms, including no fault compensation systems
8. Criminal liability for malpractice
