Aims

This module will examine the substantive law principles underpinning actions for clinical negligence and the overall context in which the compensation operates and will critically appraise the operation of these principles and the fault-based framework as a whole in this jurisdiction.

Learning Outcomes

Identify and prioritise source materials needed for a proper understanding of the subject
2.
Demonstrate a critical awareness of the factors which determine the degree of legal protection for medical negligence
3.
Analyse critically the practices within the field of medical negligence
4.
Apply knowledge concerning civil liberties in negligence, and the ability to apply it critically in a variety of contexts

Module Content

Outline Syllabus:1. Liability in contract and tort and contrasts between them 2. Liability in the tort of negligence: duty of care, breach of duty and causation, with special emphasis on approved practice and guidelines 3. Potential defendants: contrasts between vicarious and direct/primary liability, and Crown indemnity 4. Examples of liability from the spheres of diagnosis, treatment, communication and advice/information giving 5. Specific contexts e.g. obstetrics, surgery 6. Influence of resource issues on outcomes 7. Relationship between negligence liability and public law actions 8. Influence of Human rights legislation 9. Inherent problems with the tort/fault system of compensating victims
