Aims

This module will provide the students with a working knowledge of the English legal system and an introduction to the principles of the law including contract, tort and property law.

Learning Outcomes

1.
Define and explain the principles and procedures of the English legal system.
2.
Recount and illustrate the liabilities and responsibilities of stakeholders in tort and contract.
3.
Explain and discuss statutory legislation as it pertains to the construction and property industries.
4.
Explain and discuss the principles and procedures of Property law.
5.
Review the influence of sustainable development goals on legal systems and regulatory frameworks.

Module Content

Outline Syllabus:Legal Systems. Introduction to Common Law precepts, Court system and dispute resolutions. Formation of contract, terms and exclusion clauses. Performance and breach of contract. Principles of tort. Negligence and the built environment. Occupier's liability. Nuisance and Rylands v. Fletcher Introduction to Environmental law. Land and Property Law, main ways of holding land and property, rights of the property owner, other people's rights. Non-traditional land and property rights and obligations. Applied property law for property professionals, an appreciation of legal issues in building regulations and construction, planning and development, liabilities of building owners and occupiers Health and Safety law as it applies to construction and engineering projects.
Module Overview:
This module will provide the students with a working knowledge of the English legal system and an introduction to the principles of the law including contract, tort and property law.
Additional Information:The module establishes the principles and doctrines of and English legal system as part of the key role for the construction and property professional. On the Quantity Surveying Degree Apprenticeship programme, the knowledge learning outcomes for this module are K1, K4, K5, K6, and S2. On the Construction Management Degree Apprenticeship, the knowledge learning outcomes are K1, K4, K5, K8 and the skills learning outcome S2.
